西班牙性工作者獲保障 可領退休金、失業津貼

〔本報訊〕性交易合法化問題，在台灣與不少國家一直存在爭議，不管是嫖客或性工作者
都處於見不得光的狀態，而在西班牙性工作者的待遇，或許會讓不少其他國家性工作者羨
慕，因為他們不僅可和雇主簽約，享有一般勞工的權益，還可享受社會福利，失業時還可
領取救助金。

英國《獨立報》（The Independent）報導，巴塞隆納（Barcelona）勞動檢查員日前突襲
1家按摩院，發現裡面有3位女性工作者未受勞動權益保障，經過當地法院判決，法官認定
，雇主違反了3人權益，須為她們支付2012年至今的國家保險費用。

法官同時指出，性工作者若為雇主工作，需簽定工作合約以確立主雇關係，除了享有醫療
保險等保障之外，未來也可領取退休金或失業補助。

受到經濟不景氣影響，西班牙有月來越多女性投入性產業，39%的西班牙男性也坦承曾花
錢尋歡，而西班牙性產業雖在1995年就已合法，但至今仍未被視為正式就業人口，也無法
享有任何保障，而巴塞隆納法院的判決，還須經高等法院認定才能生效。

《擁勞動權》西班牙性工作者 失業有補助

〔國際新聞中心／綜合報導〕西班牙法院2月裁定，性工作者也有勞動權，應享有安全津
貼、健保、退休金，若是失業，一樣可以領取失業補助。

西班牙性產業早在1995年除罪化，但性工作不被認為是種職業，因此沒有勞動權。不過，
巴塞隆納警方最近臨檢一家提供性服務的按摩店，查獲3名性工作者之後，法官裁決該店
違反女權，公司應為店裡的性工作者支付國家保險，並追繳自2012年起的相關費用。

按摩店店東主張，這些性工作者都是個體戶，未獲僱用，按摩店在網路幫她們打廣告，成
交後，店東再支付佣金；但當局表示，店東與她們存在僱傭關係，構成契約形式，因此需
為她們繳納社會安全費用。

法院裁決保障不受剝削

法院裁決，性工作者應享有安全津貼、健保、退休金與失業補助，才能保障她們不受剝削
。這項裁定不是最終結果，業者還可上訴到最高法院。

代表性工作者發聲的馬德里人權組織Colectivo Hetaira認為，這將是全面認可西班牙性
工作者權利的第一步，希望這項裁定很快能成為法律，「這個決定太棒了，正是西班牙性
工作者所需，性工作者需要社會權、勞動權與人權」。今年1月成立西班牙第一個性工作
者合作社的費雷爾，也讚揚法官的決定，不過她認為合作社模式比較好，因為性工作者是
跟合作社簽約，而不是和雇主，等於自己就是老闆，不用受到雇主限制。

西班牙性產業因有更多女性投入而蓬勃發展，即使是在經濟危機期間也一樣。根據統計，
西班牙約有39%男性曾經召妓。娼妓在西班牙合法，但當局制定許多規定，避免性工作者
公開拉客，例如嫖客若在巴塞隆納街頭與性工作者公開談價，會被罰款300歐元（約1萬台
幣），若在學校附近毫不避諱地尋花問柳，更須面臨750元歐元（約2.5萬台幣）的高額罰
款。
