The chancellor’s announcement in this year’s budget that the child element of tax credits and universal credit will no longer be awarded for third and subsequent children born after 6 April 2017 is already highly controversial. The effect will be to take up to £2,780 per child per year from working families in receipt of tax credits.

The chancellor attempted to root his approach in a notion of fairness, emphasising that it is “important to be fair to the many working families who do not see their budgets rise by anything like that [sum] when they have more children”. But that is to compare apples to oranges and to overlook need. The implication is that if families on tax credits choose to have a third child, they should be treated, at the same time, as consciously choosing to be poorer.

The cost of welfare is thus to be reduced by policing bedrooms up and down the country. There are many reasons why the chancellor’s analysis is unacceptable and unfair but, even on his own analysis, it presents a problem. What to do about children born of rape?

Hidden away in paragraph 2.103 of the “red book” (the budget) is the following sentence: “The Department for Work and Pensions and HMRC will develop protections for women who have a third child as a result of rape, or other exceptional circumstances.”

In other words, a rape test will be introduced into our welfare law. The implication being that those mothers who can provide evidence of rape will not have their tax credits removed, presumably because they did not choose to have a third child.

This proposal is chilling. It is well recognised that the vast majority of women subjected to rape are unlikely ever to come forward and report to the authorities what has happened to them. Under-reporting of rape has been running at 80%-90% for years. Does the chancellor seriously think that women, who find the prospect of reporting a rape to the police so horrendous that they would rather remain silent, will come forward and disclose it to the DWP? That proposition only needs to be stated to be seen to be absurd; and the government’s distorted thinking does not end there.

Are women really expected to identify their third-born as conceived during rape to avoid losing their tax credits: something most, if not all, would find wholly anathema?

Make no mistake, this is a first in our welfare system. According to House of Commons library research, carried out on my behalf, “there are no similar provisions in other welfare legislation which require people to proactively identify themselves and demonstrate that they have been raped”.

At the committee stage of the welfare reform and work bill, this provision needs to be closely scrutinised and challenged.

But the problem for the chancellor is that, having based his welfare reduction approach on the supposed choice of parents to have a third child, he cannot escape the consequences. He has to make some provision for rape; but how to do so without introducing a rape test?

Dig a little deeper and the extent of the unfairness of the chancellor’s approach becomes even clearer. What about mothers who have a third child because of ongoing abuse within the relationship? Power lies at the heart of most domestic abuse, and that includes power over sex, when to have children and how many.

In 2013, the government proudly trumpeted the introduction of a new definition of domestic violence and abuse as: “any incident or pattern of incidents of controlling, coercive, threatening behaviour, violence or abuse between those aged 16 or over who are or have been intimate partners or family members regardless of gender or sexuality. This can encompass, but is not limited to … psychological, physical, sexual, financial or emotional.”

Yet women who have a third child because they fear the consequences of not complying with their partner’s threats and demands are to be deprived of tax credits because of their “choice”. How does that sit with the government’s commitment to tackle domestic violence?

The bedroom choice theory underpinning the chancellor’s budget needs to be held up to the light, closely examined and then binned.

In the real world, choice over whether to have a third child is a slippery concept and the penalty for decisions made in the bedroom, for a whole variety of reasons, should not be poverty.

Victims meant to be exempt from two-child limit, but with weeks to launch no systems are in place, claims SNP politician

The government’s plan to exempt women from a two-child limit for claiming tax credits if they have been raped are in “absolute chaos”, a leading opponent has argued, with no system in place for the scheme just weeks before it begins.

The proposal to restrict tax credit entitlement for any new claimants to a maximum of two children was announced in 2015 budget by the then chancellor, George Osborne. It included exceptions for multiple births, and also for women who could show their third or subsequent child was conceived because of rape.

Alison Thewliss, the SNP MP who first highlighted the so-called rape clause and has since campaigned against it, said that with the measure scheduled to come into force in April, ministers still seemed to have no idea how women could actually claim the exemption.

A Department for Work and Pensions (DWP) consultation last year said the determination of whether a rape had happened would be placed with a “professional third party”, which could include health workers, police, social workers or rape charities.

However, a series of parliamentary questions by Thewliss found no sign of any of these groups being given training on how the system will be run. Philip Dunne, the junior health minister, said his department was not involved in the scheme.

Thewliss said that when the system begins, women who had been raped and wished to claim the exemption from the tax credit cap would have no idea where to go.

“It’s absolute chaos. And it’s very vulnerable women who are at risk as a result of this,” she said. “From the budget in 2015, when it was announced, they’ve had nearly two years and they still don’t know how this policy is going to operate.”

It was hard to see how the system could operate at all without medical staff being trained, Thewliss said.

“The Department of health have bumped it back to the DWP, saying, ‘It’s nothing to do with us,’” she said. “But to say some has had a third child in circumstances that point towards rape, that indicates having some kind of medical evidence.”

The Glasgow Central MP said that with almost 120,000 police officers and nearly 19,000 adult social workers in England alone, the scale of any training regime was potentially enormous.

It was, she said, deeply worrying that women affected did not know who to turn to. “I’m absolutely shocked by the complacency the government has around this issue,” she said.

“In other circumstances, where I’ve asked questions of ministers and others in charge of this policy, they just don’t seem to understand how it’s going to operate at all. And they’ve had almost two years to figure this out.”

The plan has caused concern among other MPs, and women’s charities, with a number calling for it to be dropped. But the DWP announced in January that it was to go ahead after the consultation.

A DWP spokesman said the changes to tax credits were “a key part of controlling public spending”. He added: “We will be laying regulations before parliament shortly, to ensure the right exceptions and safeguards are in place and the changes are delivered in the most effective, compassionate way.”

A controversial proposal to ask new mothers who have been raped for verification if they wish to claim tax credits for more than two children has become law without any debate or vote in parliament.

The so-called rape clause, which will be applied as part of new restrictions on tax credit entitlement, was added to legislation late on Wednesday as an amendment to an existing act. The plans will come into effect within a month.

Alison Thewliss, the SNP MP who first highlighted the issue of the clause, led a furious response, saying it was an “underhand parliamentary tactic” to introduce the measure without proper scrutiny.

She also described as “frankly astonishing” the fact that the Department for Work and Pensions (DWP ) had introduced the scheme apparently without having trained any of the people who will judge whether someone claiming the exemption has been raped.

The regulations, announced in the 2015 budget by the then chancellor, George Osborne, were put into law through a statutory instrument, a form of legislation that allows laws to be amended without parliament’s approval.

The policy coming into force on 6 April restricts tax credit entitlement for new claimants to a maximum of two children, with exceptions for multiple births and for women who could show that their third or subsequent child was conceived as a result of rape.

Those seeking to claim the exemption for rape must be assessed by what the government has described in a consultation as a “professional third party”, which could include health workers, police, social workers or rape charities.

With the regulation about to come into force, however, there is no indication of how a woman who has been raped could begin the process of claiming the tax credit exemption, or whether any of the third parties have been trained.

Thewliss said she had tabled a motion of prayer for annulment, a somewhat arcane version of the early day motion, in which a group of MPs sign a paper calling for a statutory instrument to be scrapped.

Such motions can be used to register displeasure with a government plan, but they rarely overthrow statutory instruments. According to Thewliss, the last time one was annulled in this way was 1979.

“Using such an underhand parliamentary tactic to railroad the rape clause into law is just the final insult this government could possibly dish out,” she said. “Not only did ministers sneak out their shameful consultation response as the eyes of the world were watching Donald Trump’s inauguration, but they’re now trying to put the rape clause on the statute books without a vote or debate, let alone any detailed scrutiny by MPs.

“The government must accept this policy is unworkable as well as immoral. With just days until nurses, doctors and social workers are expected to verify whether women had their third child as the result of rape, it’s clear there’s been no sexual violence training for those working with such vulnerable women.

“This is frankly astonishing, especially when you consider that the government is trying to railroad this through using medieval parliamentary procedures.”

The plan has caused worry among other MPs and women’s charities, with a number calling for it to be dropped. The DWP announced in January that it was to go ahead after the consultation.

The department has described the changes to tax credits as “a key part of controlling public spending”, and has pledged to implement the exemptions in “the most effective, compassionate way”.

A government spokesman said: “It’s absolutely right that we have the right exemptions in place and we have thought carefully about how we will work with charities and health and social care professionals to support victims of rape. We will be publishing guidance shortly.”
