爭點
刑事訴訟法第33條第2項前段規定，未使被告得以適當方式適時獲知其被訴案件之卷宗及證物全部內容，是否違憲？

刑事訴訟法第33條第2項前段規定：「無辯護人之被告於審判中得預納費用請求付與卷內筆錄之影本」，未賦予有辯護人之被告直接獲知卷證資訊之權利，且未賦予被告得請求付與卷內筆錄以外之卷宗及證物影本之權利，妨害被告防禦權之有效行使，於此範圍內，與憲法第16條保障訴訟權之正當法律程序原則意旨不符。有關機關應於本解釋公布之日起1年內，依本解釋意旨妥為修正。逾期未完成修正者，法院應依審判中被告之請求，於其預納費用後，付與全部卷宗及證物之影本。

→亦即，刑事案件被告不管有無請律師，都享有完整卷證獲知權。

〔即時新聞／綜合報導〕長期關注環保議題、支持同志權益的美國知名人權律師巴克（David Buckel）14日在紐約自焚身亡，他在遺書中寫到，他用化石燃料自焚，隱喻人類以此毀滅生態。

綜合外媒報導，路人在布魯克林的展望公園發現巴克的遺體。警方表示，當地時間上午6時30分，60歲的巴克被宣布死亡。巴克不僅在現場留下遺書，也在死前通過電子信件寄給幾家大媒體，包括《紐約時報》。

巴克在遺書中提到化石燃料對地球造成的傷害，大部分人正呼吸著受化石燃料污染的空氣，造成很多人早逝，他用化石燃料自焚以反映此事。他也為自己留下的爛攤子道歉。

巴克在遺書上表示，他的行為並不是新鮮事，有許多人在認為沒有其他方式可有效地解決他們所看見的傷害後，也選擇自焚引起關注。他說，希望他的死亡可以影響他人。

除了環保，巴克也長期支持LGBT議題，擔任捍衛同婚權力組織的顧問。巴克早年曾為變性男子蒂娜（Brandon Teena）於1993年遭強姦及謀殺一案擔任律師，案件在當年轟動一時。

這起事件後來在1999年翻拍成電影《男孩別哭》（Boys Do not Cry），女主角希拉蕊· 史旺（Hilary Swank）成功拿下奧斯卡影后。

一直有人挖我太陽花的老照片。沒錯，我立場是支持太陽花運動的，當年還有30秒通過服貿決議的立委，下條子要關說我非醫療事務(剖腹看時)，也被我3秒拒絕了。

不過當時下班後我進議場，不是為了抗議，我們是緊急醫療隊的身份，醫療對象包括警察朋友。我們可以說，當年沒我們在，人員受傷的狀況一定更嚴重。

當年的中山南路只有封住一個慢車道，雙向都可通車，和最近的陳抗，只為了數千人，把醫院大門封鎖，中山南路完全封閉；有次甚至申請路權擴大到比國慶或總統就職都還誇張，救護車進不來出不去，要開刀的醫療人員進不來，不可同日而語。

記得太陽花當年的大型抗爭，主辦單位都會租用流動廁所，更不會像這次抗爭，連給病人坐的位置都佔滿了。

民眾有抗議陳情的權利，但並沒有打人、打擾病人和醫院作息的權利。

印度一位23歲年輕媽媽，穿著不習慣穿的高跟鞋帶6個月大的小孩出席婚禮里，結果在婚禮現場跌倒，小孩從她手墜落不幸身亡。

據《正午報》(mid-day)報導，印度一名23歲媽媽謝赫(Femida Shaikh)，帶著6個月大的小孩穆罕默德(Mohammed)參加婚禮，即使不習慣穿高跟鞋，謝赫出席時還是特意盛裝打扮一下，但她抵達婚禮會場，從二樓走向一樓之時，突然失去平衡跌到，手中的嬰兒順勢掉落到一樓，穆罕默德因這一摔傷到了脊椎，送醫後不幸身亡。

當地警局的助理警員克赫德卡爾(Vijay Khedekar)說，事件發生後他們就立即趕到現場，將嬰兒帶往醫院治療，但嬰兒在醫院被宣布死亡，謝赫和她的親人敘述了事情經過，目前已經認定為意外死亡，並將遺體交給家人。（即時新聞中心／綜合報導）

在我剛進公司的時候，第一個和我吃晚餐的同事就是她，非常的認真、負責、努力，比我小兩個月卻像是我的大前輩

我們周二會固定一起去健身房，她最近在忙標案已經兩三周沒一起去了，上周她還和我說等6月案子結束她就回歸

在上週五的一場車禍之後，再也沒有履行的機會了。

週末時得知她出了嚴重的車禍，昨天公司很多同事一起去為了她拜拜祈福，或許是不希望她受太多的苦吧，昨日凌晨她默默的離開了

今天的公司是我到職以來氣氛最糟的一天，每個人或多或少都受到了影響，我也無意批判司機或是其他的什麼

只是希望還原事發經過，如果司機真的無辜也還他一個清白，若否也至少在法律上給我同事一個慰藉。

港區巡守人員昨日晚間8時許，發現有一輛汽車直直衝進港區，立刻通報相關單位派員救援，海巡隊員在港區的海面上，發現汽車落海處有一個人頭浮出水面，馬上拋擲救生圈給落海人員，協助他上岸。

蘇翁上岸後，向救援的人員道謝，並表示自己身上沒有傷，意識也非常清楚，並不需要救護車送醫；還好當兵時受過兩棲蛙人訓練，深諳水性所以在車子落水後，還能從副駕駛座內脫困，沒被車子拖進海中。

基隆港警總隊人員對蘇翁進行酒測，酒測值為0，並無酒駕情形，但因為車輛落海地點位於東17碼頭，該處為馬祖航線貨輪靠碼頭，常有貨輪進出，擔心衍生航安問題，立刻通知基隆港務分公司派吊車將落海車輛吊起，暫時安置在碼頭邊。

〔記者蔡政珉／苗栗報導〕苗栗縣大湖警分局一名女警13日在台3線執行移動式測照勤務時，隱身路邊雜貨店騎樓，還因怕蚊蟲叮咬在制服外加穿外套，結果被眼尖重機騎士抓包，將影片上傳YouTube，諷刺是「警察最強偽裝術」，大湖警分局表示，該名女警服裝違反規定，將記申戒一次懲處，而1小時拍到的16張超速罰單也因此作廢不舉發。

大湖警方今天解釋，該名女警是為了避免蚊蟲叮咬，所以私自加著個人透氣外套，已依規定懲處記申誡一支，至於網友質疑警方偷拍取締，警方解釋，該女警執勤地點前方100公尺處已設立告示牌，提前警示用路人注意，並非突襲偷拍，不過為了避免爭議，將撤銷當天該時段拍得的16張罰單。

大湖警方表示，警方執行勤務必須穿著制式服裝，該女警的確違反勤務規定，因此該時段所拍攝到的違規行為通通失去法律效力。

我第一次坐滴滴順風車的時候，其實就有點不太好的感覺，我一上車，司機就很開心地說：「我昨天跟我老婆說，我今天會載一個台灣導演喔！」。其實我聽完以後有點愣住，因為我從來沒有在個人資料提及，我是個導演。

另外一個故事，我有個大陸朋友，要帶寵物回別的縣市，他在滴滴順風車上發了兩天的消息都沒人接單，最後女朋友看不下去，用自己的手機帳號幫他發單，不到三分鐘，馬上就有司機接單。

回頭來看滴滴的空姐姦殺案，你覺得司機有沒有可能預先知道，這個深夜乘客是個年輕貌美的空姐，進而預謀犯案？而滴滴司機是怎麼知道這些乘客的個資？這就要來談到滴滴的業務層面問題了。

在滴滴打車系統上，有分「快車」、「專車」、「順風車」幾個業務，其中快車是兼職的網約車司機，專車則是專職司機，這兩項業務是由滴滴這家母公司所經營，但是「順風車」這項系統卻是由滴滴的子公司所經營，在滴滴的規避之下，順風車並不算是網約車，而是屬於「共乘車」的類別。

也就是說，「共乘車」並不像「網約車」一樣受到嚴格的法律規範，由於乘車費用便宜很多，再加上滴滴有心把順風車當作是交友平台經營，所以在順風車上，就可以看到司機對乘客的評價，這些評價發展到最後，就成為了犯罪溫床。

從上面這張截圖，我們會看到什麼？司機對乘客的評價是「美女」、「顏值爆表」、「膚白腿長」、「聲音甜美」、甚至絲襪下車時容易走光會想入非非這樣的話都會出來，而這些評價就會一直在系統上伴隨著乘客，成為其他司機載客的依據。

再看一下這張圖，這張圖也說明了乘客的大致身份，包括年紀、職業、手機品牌、幾位共乘的乘客，乘客個人資料一覽無遺。如果你是女生，你會不會感到害怕？

滴滴公司必須要完全負起姦殺案的責任，因為在滴滴的系統上，司機可以預先幾個小時就知道，他會在深夜時分，載到一個膚白貌美長腿的空姐，而且她只有一個人。

當你使用滴滴順風車系統時，你的個人資料會完全攤在陽光下，你沒有隱私，空姐姦殺案就是沒有隱私所造成的悲劇。又因為這件事情是發生在「順風車」系統上，滴滴母公司可以規避掉大部分的法律責任，這就是無良公司的可怕之處。

蘋果公司的執行長庫克不久前回到母校演講，就暗指了Facebook犧牲用戶隱私權，會產生不可預料的危險，也表明了蘋果會採取截然不同的作法。

「我們盡可能不收集太多關於你的資料，因為我們知道那是屬於你的東西。我們會捫心自問我們應該做什麼，而不是我們能做什麼。」

套句諾基亞公司的標語，科技始終來自於人性，犯罪也是。

當人類闖入野生動物棲息地，動物又展現出「野」的一面，人類應該怎麼做呢？當然是殺掉了。美國NBC新聞報導，一艘郵輪載著遊客到北極圈觀光，郵輪警衛通常會先下船，檢查該區域是否有任何危險。當時警衛沒有注意到北極熊在鄰近區域活動，北極熊出於本能攻擊一名警衛，使該名警衛頭部受傷。另名警衛當下立刻以「自我防衛」為由，開槍射殺北極熊。值得慶幸的是，受傷的警衛傷勢不重，其他人也都十分平安。但這頭野生的北極熊，卻只因行為舉止表現得像野生動物一樣而被擊斃。德國郵輪公司「赫伯羅特郵輪」（Hapag-Lloyd Cruises）發出道歉聲明，但也聲稱警衛為保全性命不得不這麼做。多數人都在社交媒體上表達憤怒，英國喜劇演員瑞吉葛文（Ricky Gervais）和動物保育人士都出面指責，認為人類闖入北極熊居住地的行為很「低能」。

問題就是現在假新聞假消息已經太過度了。假新聞已經造成川普當選與脫歐了，台灣這邊假新聞也很扯。

不是說要立法或什麼，但是如果沒有在積極一點的作法，到時候政府甚至人民怎麼死誰知道。

王王冷在這邊危言聳聽用白色恐怖來比喻，我真的很想吐槽。

民進黨有民進黨的問題在（包括之前勞工遊行給人家弄拒馬展、或是拿出之前國民黨政府提議管制YouTube之類的網路媒體），他這邊只顧批評，為何不提說執法力的問題？這樣跟米果時報說臉書是綠的、綠色恐怖有什麼兩樣？

（當然啦，如果執法能力還是太差，最後做出的防治假新聞條款還又只是疊床架屋）

現在很多假新聞或是錯誤訊息，快速下架就沒事了，可是卻缺乏闢謠的。很多看電視新聞與報章新聞的人只看電視與報章，真的闢謠後的消息會看到嗎？

就連去年台鹽使用幅射性物質的錯誤爆料，到現在還有人在LINE上面傳。

我覺得這議題是在浪費我們時間，偏離重點。SNS不過就是種傳遞訊息的途徑，效率卓越，門檻低，就這樣。

上個世代的媒介：電視新聞、報章雜誌、記者 ..... 消息也沒比較可靠，更上一個世代的媒介：書本、手稿、言語傳遞.....消息也沒比較可靠阿。

新聞記者在扼殺人的心智、這些作品文宣充滿激進思想、那些書本傷害年輕人的心理健康、進一步政治工具化？

書商雇用了宗教的高層傳教員.....。這些句子隨便套都很真實。

所以我覺得問題歸納到 : 發表的內容是否要審合，發表的內容(不論真假)影響到他人是否需要負責，內容為假要負怎樣程度的責任，是否該針對"不當言論"新增法律 ......

不過以上的問題，我想愛好自由的人一定是全部反對的吧

說穿了，要線縮別人說話就只有降低言論自由一途而已。

該怎麼說呢，有些人就是覺得自由就是無上限，不知道自由的對等字是責任。那些人不是真的愛好自由，而是自以為愛好自由。

然後，還有些有心人士就喜歡依附在這些人後面跟著喊言論自由。我不是喜歡審查的人，但是這些人真的逼得不得不對很多資訊審查（基本的反歧視、刪除假消息；而非極權國家那種言論控管）。

與其說降低言論自由，不如說提昇"自由與責任"之意識吧。

不然像是8.4那種愛限制他人自由的，就很愛說"太自由"、"你看吧(下略三百字)"、"所以中國這樣還是有好處的"。已經聽這種話看這種嘴臉不知道聽、看了多少年了。

若理解到這一步的話，那再來就是大眾認知的 "程度" 問題而已 : "自由的界線要劃在哪"。 這種議題就算再吵個百年大概也不會有結論。

所以我才認為那些文章都是屁話，浪費時間。

我是比較偏激(?)啦，所以也常跳針。我是不會說 "自由的界線"，而是繼續強調"自由與責任"。然後，這議題就跟很多議題一樣，吵到世界末日也很難有結論的（一翻兩瞪眼的科學理論都有可能被推翻了，更何況這種社會科學之類的討論）。

只是這些議題不是因此就不用討論，或是提出來提醒。我們知道不代表其他人也知道。因為永遠會有些人會因為提醒才知道的，那怕只有一丁點人會醒來，都還是有需要的。

同樣的問題，不過就是把書本、新聞、雜誌，改成SNS而已。幾百年來就浪費時間在這議題上，沒有進步。說那些言論都屁話是因為他們都只是在找個罪犯而已，避重就輕，根本蓄意誘導誤導人。這東西當然要討論，但問題要從根源說起。最後，讓人醒來才是重點，那就是 " 自己沒有驗證過得東西都不要相信，無法判斷的事情不要附和 "

草原是一個我很喜歡的地方，只要不觸犯法律、不要影響他人，可以自由自在地做我喜歡的事情，不用顧及外人的目光。無憂無慮的躺著吹涼風看星空，遺忘掉生活上的諸多煩惱，將無形中栓在身上的枷鎖全部卸下。

原先就知道有部分人士不滿草原，例如拍下堆積在一旁，尚待整理的物品，把圖貼到網路上說參加者都是沒公德心的8+9，隨地便溺到處都是垃圾。又或是信誓旦旦的說看到有人嗑藥吸毒雜交之類。

今天看到新聞就預料到了，那些人肯定會藉題發揮，萬萬沒想到會演變成這種局面，發生不幸的事誰都不願意，但為什麼要把過錯全推到主辦方頭上？

「主辦方包庇犯罪者！」
「主辦方沒盡到管理職責，也是共犯！」
「發生這種事情居然還繼續辦活動，你們有沒有同理心！吸毒嗑藥搞到腦子壞了嗎？」

這類的攻擊性言論層出不窮，彷彿所有參加者都是十惡不赦的罪人一般，也許真的有什麼不滿，也許只是無聊亂起鬨，但這些言論卻傷害到許多真心喜歡草原的人。

因為那些言論，整天都心情不好，
我　他　媽　邊　看　邊　哭，
只剩沒幾天，為什麼不能好好收尾，
一個活動要被攻擊成這樣…。

草原的事情過了這麼久，風潮和火勢大概退了，來稍微碎碎念一下。

我的想法大致上和這篇類似，在忙碌繁雜的都市或者說現代生活中，難得有個可以讓人拋開多餘的顧慮，放下手機及諸多繁忙事物，敞開心胸、隨興自由地以相對真實的面貌去接觸自然和他人。這大概是所有喜愛草原的人的想法。

既然說了是大致上相似，當然也有不同的點。

可能我比較愚昧，還是天生反骨，又或是腦洞大到沒法補，我看完這篇文章其實有點不舒服。

身為喜歡草原的人，很樂於見到有平衡或正向的報導，但這篇文章洗白洗得有點過頭了…。

當初聽到「佔領」時滿腦子都是問號，聽完說明還是問號，看完這篇說的更是問號到不行，到現在還是無法理解主辦方的想法，一個正面積極引人反思的活動，就不能合情合理合法的順利完結嗎？為什麼會想用一個抗爭而且注定會被抹黑的行為做收尾阿？？？

洗白不是不行，但洗到這種程度就有點尼克羊問號的感覺。

【公共空間與公共性】

那是我第一次來到草原，也許也是最後一次。
我記得我轉頭對她說：「我覺得台北市很少這樣的公共空間。」

我一直覺得公共空間不是一個空間可供公眾使用而已。
公共空間需要具備「公共性」－－在空間上的公共性，以及空間與人交互作用下的公共性。

台北市都市更新自治條例第19條中詳列的各獎勵容積的辦法，我還記得剛畢業那年找租屋去看房子，隔壁就有一塊綠地。

字面上的意思，種了幾棵樹，狹長的綠色草坪。
我不太確定可以在那邊做什麼? 或有誰會在那裏待著?

上頭立了都市更新的告示牌，兩頭有鄰近住戶抗議的標語，大意是道路因此變小了。
（可能是停車變不方便了吧haha）

時光彷彿回溯到念書的那年，那一年，我還在修都市社會學。從康樂里到寶藏巖，從樂生到蟻族。那一年，文林院還沒有拆除。

我就讀的學校非常的小，從前門走到後門大概十分鐘吧，學生能待的地方，除了教室就是廣場的椅子、學餐。

公共空間可以是一個地方，就擺幾張椅子，可能晚上沒有燈，都是蚊子。
公共空間可以是一個地方，可能立了幾個「裝置藝術」「美化」。

就像一樣是公園，有些公園就是一塊綠地，放幾根像柱子的東西；有些公園有基礎的照明跟座椅，有些設置了提供運動休閒的設備，公共空間在空間上，可以帶有「積極」作為公共使用的目的的。

即便帶有積極作為公共使用目的的空間，可能也不然真正被公眾使用到。

空間是生成的，在我們談「迫遷」的時候，我們談的不是「換了一棟房子」，對於有些人來說也許是「搬家」，但對於有些人來說可能是「移民」。

獨居眼盲的奶奶，離了他閉著眼睛可以摸回家的地方，會幫他買飯問候的鄰家。

空間是時光與記憶的載體，文化在其中醞釀。
而我在草原看到的公共性是這樣的。

人與嘗試，試圖活化的公共空間。
就像她跟我說哪個裝置藝術是哪裡來的，誰又帶了什麼，那不是一個人，或是誰的意志，而是一群人一點一點建構的，某種東西。

是草根的、是批判的、是多元的。
是的，也可能是危險的。

我是曾在那裏感到不適跟小心的，來搭話的男性也曾讓我白眼翻到後腦勺。
但我也不只在這裡遇到過讓人白眼翻到後腦勺的人。

草原包容了許多可能性，確實，他也是某些族群的同溫層。
－－它是可能作為「誰」的空間的。

我可以理解，為什麼「都市不需要公共空間」，要水、要電、要維護，是挺「不經濟的」。
在都市裡，我們不乏「消費性空間的選擇」，咖啡館往往不是「賣咖啡」而是「賣空間」。

賣一個下午的安寧，在私領域以外的地方閒聊，有空調有飲水和廁所。

公共空間是要有「公共性的」，所謂公共性，可以是空間上的公共性，抑或是人與空間對話的公共性。

〈錯誤標籤機〉
我不知道這篇會有多少人看，反正是一個救一個。

關於最近的強暴分屍案，深受其害的賽德克朋友憤怒地表示這個人根本不是原住民而是漢人。(據消息連他賣的文化都是假的)

這個憤怒是應當且必然的。一個人犯罪就是犯罪，和他的族群全然無關——況且這個人的罪還被和特定的族群連結，無論媒體有何居心，他們都應該為此感到羞恥。

而我呢，我比較想知道媒體什麼時候要放過所有非多數的族群？包含種族的、包含性別的、包含身份的。

殺人就是殺人。也許我們可以探討他的過去，探討事件的本質以避免同樣的悲劇再次發生，但那些無關乎罪刑本身的條件，原本就不該在事件中被提及以混淆視聽。

試想如果有個人因為你在菜市場殺價就說：「只有漢人才會貪小便宜。」你心裡作何感想？

我相信除了對自己一切自卑的人以外，大部分的人第一個想法是：

「靠腰ㄛ！跟我是不是漢人有沙小關係？？？」

那些在媒體被標籤化，被惡意放大的族群心裡就是這樣想的。

當你在每個過錯、罪行都貼上標籤的時候，你的每個行為都正在對這個標籤背後代表的族群造成傷害。

而我相信每天該該叫「這座鬼島怎麼這麼亂啊你看看國外好多ㄌ」的台灣人們想必也受夠這些互相仇恨所造成的亂象吧？

那麼，不喜歡「亂糟糟的鬼島」的台灣人唷。

你們現在有個很簡單的任務能讓台灣更平靜唷。

丟掉你手上的白癡標籤機。

前些日子有個朋友寫了一篇文章，說華山現在大致可以分為兩個部份：很多建築物那邊的藝術是比較主流與商業包裝的，後面大草原發生的藝術實踐則是比較草根。一邊門檻高，另一邊門檻低；一邊有錢有資源有話語權，而另一邊只有人。

為什麼突然說這個呢？

草原上發生事情之後，很多人突然跳出來說他們早就知道那邊會發生這種事、那邊就是一群不知道自己在幹嘛、自稱是搞藝術其實都在吸毒打砲的人、那邊的人感覺就是一副非常符合犯罪者的刻板印象的樣子等等的。

我想說的是，這種聲音絕對不是一天兩天，而是剛好突然有件事讓他們爆發。這其實說明的是這些人對草根的藝術實踐者的不理解。然而發生這種事，這樣子的想法突然大量地爆發出來了，這對這些非主流的藝術實踐的環境勢必會造成一個非常不好的影響：那些歧視與偏見一下子被檯面化了。當然這又會直接帶出什麼是藝術的問題。

能夠理解我在說什麼嗎？如果事情發生在商業的華山那邊，不難想像輿論的方向會完全不一樣，我想至少不會有對所謂藝術的這個標籤以及連帶被提及的其他莫名其妙出現的標籤這麼嚴厲的批判。出了事胡亂貼上一些標籤證明那些人是非我族類往往是成本最低廉也是最容易的，而這些在體制外遊走的人又正好相對容易被貼上非我族類的標籤。然而這樣做其實非常不精準，基本上無助於解決問題，只會帶來歧視與壓迫。

接下來可以想見草原收回去都更蓋個不知道對我們市井小民有何意義的司法大廈。進一步如果不幸整個USR計畫被中止，那些政策實驗失去可以執行的地方，整個氛圍會是倒退的吧。

之前在推特上看到一則尋人啟事，因為失蹤地點在華山那區，算是臺北市熱門景點了吧，而且宅如我昨天也有經過；當時還跟親友說尋人啟事最可怕的點是「找不到」、「消失」的感覺，然後剛剛就在推特上看到破案了。不想精神創傷的就不要去搜了。

 不到一個月的時間，我們聽到了兩起分屍案，一個想要分手，一個抵抗性侵，兩個女生就這樣被殺害分屍了。

必須先強調，我並沒有說男人不會受害。因為，每次有人在說男人對女人做了什麼的時候，總有人說我們似乎認為只有女人會受害。當然不是，我們知道男性也會受到性暴力，也會被謀殺。我們只是在談一個結構性的問題。

就像我們依然在談男人和女人如何，並不是因為我們相信性別的二元論。剛好相反，正是因為我們不相信這種二元論，但我們看到這種二元結構依然控制了社會中的人對待自我和他者的方式。換言之，我們實際上依然生活在這樣的性別結構中，並因此不自由。

有一種帶有高度攻擊性的陽剛特質，往往被美化成男性的粗獷魅力。為什麼不能接受拒絕？為什麼認為這個女人就是你的？為什麼認為自己有權利去對一個女人做任何事情？這是一種對人的不尊重？沒錯，但尤其不尊重女人，不尊重小孩，不尊重任何不像他們那麼男人的人。尊重，對這樣的社會來說，也是有位階的，而且往往和性別特質的位階互相重疊。

男人是什麼？這個問題和「女人是什麼？」，以及「人是什麼？」一樣重要。只要性別特質的結構依然建立在獨尊主流陽剛特質的位階上，不僅女人和其他性少數需要解放，男人更需要解放 -- 需要從這種性別位階中解放出來，尤其是從強大陽剛特質的迷思中解放出來。

台南市一名就讀國中一年級、家境單親清寒的13歲李姓少年，從小學五年級開始，他就利用自己的「年齡輩份」，霸凌勒索大他1歲的「姪子」，3年時間共拿到6萬多元，對方家屬察覺有異，事情才曝光；經老師約談，少年嚇得在白紙上寫下高達97筆帳目，包括劃除未得逞的次數，令校方錯愕。

根據《蘋果日報》報導，警方調查，就讀國中二年級的14歲被害少年時常向阿嬤要1000元鈔票，繳完書錢沒多久又要繳補習費，察覺有異，因此向導師反映此事，才知道原來少年長時間被人勒索，對方竟然是小他1歲、住附近且有親戚關係的13歲「叔叔」。

由於論輩分得稱對方「叔叔」，被害少年從小學六年級開始就被各種名目勒索要錢，雖然兩人從小學畢業後各自就讀不同的國中，但放學或假日後，「叔叔」仍會霸凌威脅，讓少年相當害怕，只好向家人騙錢或偷錢，再帶到學校門口交易，每次約是從1、200元至1000元鈔票不等。

報導指出，校方啟動機制輔導調查，要求李姓少年寫下悔過書，他認錯寫下犯案次數、參與人數、索討金額等事項，寫了滿滿5張，總計97筆帳目，誠實吐露這3年來所有的勒索。校方起初懷疑少年亂寫，但他則解釋，有些沒有順利拿到錢，開始拿紅筆扣掉近50筆紀錄，估得手金額高達6萬多元。

李姓少年否認幕後有指使者，僅是他一人犯案，校方兩個月來共輔導各8次法治教育與人際關係。調查指出，李姓少年來自單親清寒家庭，父親無業，他不愛寫作業、成績中下，但他卻擁有超強記憶力，記下97筆紀錄，因此校方認為欠缺栽培，得加強學科基礎教育，再鑑定資優生為否、並輔導他步入正軌。

行政院消費者保護處為改善黃牛大量搶（退）藝文表演票券頻傳問題，擬定業者舉證後可拒絕黃牛辦理退（換）票機制，並擴增現行1種退票方案至4種，6月可望有法可管。

消保處簡任秘書陳星宏舉例，近年來流行樂界演唱會，例如江蕙封麥演唱會、五月天跨年演唱會、張學友世界巡迴演唱會售票情況都是秒殺，也會出現黃牛大量搶（退）票問題，濫用現行退票機制，導致業者營業損失，加上高價售票，更是損害消費者正常購票的權益。

陳星宏說，因此消保處促請主管機關文化部研擬「藝文表演票券定型化契約應記載事項」修正草案，相關草案已送行政院審議，最快文化部有機會在5月公告，6月就有法可擋。

他說明，新制有兩大修正重點，一、只要業者可以舉證購票非自用，就可以拒絕對方辦理退（換）票；舉證方式例如證明是被警政機關法辦過的人，或者業者可提出過去售票活動的購票資訊證明其為黃牛之一。

二、擴增現行1種退換票方案至4種，明定業者應依藝文表演性質，就以下4種方案擇一勾選，作為退(換)票的處理方案機制。

方案1，現行退換票方案，註明退（換）票應於演出日前幾日（最多10日），手續費不得超過票面金額10%。

另外三個方案為新增退換票方案，分別是，方案2，退（換）票應於購買票券後3日內，手續費不得超過票面金額5%。方案3，註明退（換）票應於演出日前幾日（最多20日），手續費不得超過票面金額10%。

方案4，採級距式退（換）票處理規範，包括：演出日前第31日前辦理退（換）票者，手續費不得超過票面金額10%；演出日前第11日至30日內辦理退（換）票者，手續費不得超過票面金額30%。

以及演出日前第3日至10日內辦理退（換）票者，手續費不得超過票面金額50%；和演出當日至演出日前第2日內辦理退（換）票者，業者得不予退、換票。

花蓮明義國小之前的校園保全薛安程，不只記憶力超，還認得所有小朋友跟家長，更曾經協助警方抓過嫌疑犯，深獲大家信賴。但因為校方經費不足，新學期沒獲得續聘。但還好立刻被另一所私校延攬。到新學校才短短幾天，已經記住不少家長的車輛與學生姓名，也讓新學校的師生超佩服。

竹市校園屋頂種電啟用 每年可供1500戶家用、減碳3000公噸

新竹市府去年3月起在市轄29所中、小學屋頂設置太陽光電發電系統，今天舉行啟用儀式，市長林智堅說，太陽能光電系統建置後，不僅年平均減碳量達3000公噸，同時面板下的樓層可「降溫」至少3到4度，很多學校老師和孩子都說降溫有感，而校園種電的發電量，更可供1500戶家庭每年的用電量，市府今年將擴及所屬公有建築也來種電。
